Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Vaulken cloud platform ("Service") operated by Vaulken ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Definitions

  • "Service" means the Vaulken cloud platform, including the MCP server, dashboard, APIs, and all related services hosted at vaulken.dev.
  • "Customer", "you", "your" means the individual or entity that registers for and uses the Service.
  • "Customer Data" means all files, content, and data that you upload, store, or process through the Service.
  • "Workspace" means an isolated tenant environment within the Service.
  • "Vault" means a configured storage connection within a Workspace.
  • "BYOB" (Bring Your Own Bucket) means a Vault backed by your own S3-compatible storage that you provision and control independently.
  • "Managed Storage" means a Vault backed by storage provisioned and managed by Vaulken on your behalf.
  • "Access Config" means a client configuration that grants scoped access to a Vault via the MCP protocol.

2. Account Registration

To use the Service, you must create an account with a valid email address and password. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You must notify us immediately at hello@vaulken.dev if you suspect unauthorized access.

3. Service Description

Vaulken provides an AI file vault system that exposes storage operations via the Model Context Protocol (MCP). The Service includes:

  • File operations (read, write, search, patch, delete, move) via MCP tools
  • Full-text and semantic search across indexed files
  • A web dashboard for managing Vaults, access settings, and your account
  • An authorization server for secure MCP client access

4. Customer Data Ownership

You retain all rights, title, and interest in your Customer Data. We do not claim any ownership over your files or content. We access your Customer Data only to provide and improve the Service as described in these Terms and our Privacy Policy.

5. Data Processing and AI

  • No model training. We do not use your Customer Data to train, fine-tune, or improve any machine learning model — ours or any third party's.
  • Search indexing. When search is enabled, your file contents are processed to generate search indexes. These indexes cannot be used to reconstruct your original text.
  • No file content in our database. Your file contents are never persisted in our database. Only search indexes and file path metadata are stored. The actual files remain exclusively in your storage.

6. BYOB (Bring Your Own Bucket)

When using BYOB, your files remain in your own S3-compatible storage. We store your storage credentials in encrypted form using a key management service. You may revoke access at any time by rotating your credentials. Our search indexes for BYOB Vaults become non-functional without bucket access but remain in our database until you delete the Vault.

7. Managed Storage

When using Managed Storage, we provision and maintain the storage on your behalf. Your data is stored in the EU (Paris, France). Upon deletion of a Managed Vault, all associated files and indexes are permanently deleted.

8. Access and Scopes

Access to your Vaults is controlled through Access Configs, which define permissions (read, write) and optional path restrictions. You are responsible for configuring access appropriately and safeguarding the generated credentials.

9. Acceptable Use

Your use of the Service is subject to our Acceptable Use Policy, which prohibits illegal, harmful, or abusive use.

10. Availability and Support

We strive to maintain high availability but do not guarantee uninterrupted access. The Service is provided on a commercially reasonable efforts basis. Scheduled maintenance will be communicated in advance when possible. We do not offer SLA guarantees at this time.

11. Fees and Payment

Certain features of the Service may require a paid subscription. Fees are billed in advance on a monthly or annual basis and are non-refundable except as required by applicable law. We reserve the right to change pricing with 30 days' notice. Continued use of the Service after a price change constitutes acceptance.

12. Suspension and Termination

  • By you. You may delete your account at any time from the dashboard settings. Upon deletion, all your Workspaces, Vaults, indexes, tokens, and account data are permanently removed.
  • By us. We may suspend or terminate your access if you violate these Terms or the Acceptable Use Policy, or if required by law. We will provide reasonable notice when possible.

13. Intellectual Property

The Service, including its software, design, documentation, and trademarks, is owned by Vaulken and protected by intellectual property laws. The open-source components of Vaulken are licensed under the MIT License. The Enterprise Edition components are proprietary and require a separate license.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAULKEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

16. Indemnification

You agree to indemnify and hold harmless Vaulken from any claims, losses, or damages arising from your use of the Service, your Customer Data, or your violation of these Terms.

17. Modifications

We may update these Terms from time to time. We will notify you of material changes via email or through the dashboard. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Paris, France.
